Picture used without permission.

Someone has taken my picture and put it up on this site as their own....maybe they've done it with others photos too?

It says..." You can upload your own photos of animals to this photo gallery and share them with people all over the world."

"The image you are to upload to this archive should be copyrighted by yourself or copyright free."

I didn't give anyone permission to upload or use my photo.
 
This is an interesting situation. They are not claiming that anyone but you have copyright to this photo , as your name is clearly on the pic. But, they have taken the liberty of thumbnailing it and redirecting to the original website .

I would expect that they should need to seek your permission to do this....
 
It clearly states on the site that you can upload YOUR OWN photos...the photo doesn't belong to the person who uploaded it...so they broke the site's rules regardless of the copyright.
 
there is a delete button. When I pressed it it asked if I really wanted to delete it . I didn't proceed any further. You may want to try it.
 
THere is also this disclaimer on the page...

AnimmalPicturesArchive.com does not have the copyright for this image. This photograph or artwork is copyright by the photographer or the original artist. If you are to use this photograph, please contact the copyright owner or the poster.
 
I did try...you need to be a member to do it.
I tried the "Powered by Krystal IRMS" at the bottom and it gives me a page in (likely) Korean.
I tried "share ur opinion" and it does no good either.

I know this is 2 weeks old. It looks like this site archives photos of animals and does not use the photo for anything such as advertising, for sale, etc... So its not really in violation of copyright laws. Its just like if you look at Google images. The bots crawl sites for pictures to add to the directory. I'm sure no one has been asked by Google if they can add your picture to their database. Google would be sued for billions+ if it was in violation. As long as its not being used for someone else's profit I wouldn't sweat it.
 
I'm not a computer person or a copyright expert, but I think this is a closed site (correct me if I'm wrong). What I mean is if you go to Google images and put in chameleons, I don't think pictures on this site come up. Someone had to come on here and upload it and use it in a different site that is exposed to the search engines before it would come up. That is use without permission, plus it is a violation of the rules of this site.

Also, even on Google images, it takes you to the origin site. To take it and use it for your own, you'd have to download it from the owners site. I think that still constitutes use without permission. Whether or not there is a cause of action for damages would depend on how the picture was used.
 
I see what your saying. This is a closed site its part of the programing of the site so bots like Google's wont archive pictures and things. The picture that this thread is about was on another site obviously that wasn't "closed" and it was picked up by the animal archive site mentioned in the post. If it was from this site then thats a different story. The site in question does also redirect you to the site of origin. I'm replying so its this much more info for people to learn.
