Hey i was wondering if anyone on here knows california state law in accordance to traffic stops. I got pulled over at 730 on the freeway. Officer said i was going 90, i was doing prolly 85. I know i absolutely did not pass him so my only thought is he used his radar gun. My question is, is it considered entrapment if he uses his radar gun at night, when i can't see him?
 
He could get your speed by following you for a certain distance so he would know how fast you were going.
 
you are SOL man... no such laws exist anymore. entrapment is a thing of past. sorry you got a speeding ticket. they can hide anywhere now. sucks dont it?
 
One of my employee's tried to fight a ticket about 2 months ago. he used all kinds of examples of the officer not following proper procedures, not having his radar gun re-calibrated, positioning of the officer and his motorcycle, other cars in the line of sight, etc. the judge gave him a look that said, "So?" and that was it. Good luck if you try to fight it but know that you're most likely fighting a battle that you can't win. :(
 
i think ur outta luck with this one an bein 90 he could have even arrested you for wreckless driving...

Entrapment is when you are induced to commit a crime by an officer that you would otherwise not have committed. If they had a sign out saying "No officers on duty so you're not going to get a ticket, speed away" and then they pulled you over for speeding, that would be entrapment. You just got caught breaking a law that you were going to break without their encouragement anyway.

Maybe DJ can jump in here and tell you more about the law.... But honestly... what the hell are you doing 90 MPH for? Even if it was 'prolly' 85... why? What on earth are you going so fast for? I have passed cops on the fwy who are going 65 and i am doing 75. If you aren't being a freakin moron you won't get pulled over. Something tells me you weren't 'cruising' and made a few lane changes.. causing the officer to notice you. Oh... and you look 15, so I am sure your age, speed and car had a lot to do with it. Don't you drive a BMW or huge SUV?
